Please read this document carefully! It contains very important information about your rights and obligations, as well as limitations and exclusions that may apply to you.

This Agreement contains the terms and conditions that apply to purchases by customers from IDC Diving Centre Ltd. ("Customer") on orders for scuba equipment, related products, services, and support. By accepting delivery of the equipment, products, or services described on the invoice, Customer agrees to be bound by and accepts these terms and conditions.

THESE TERMS AND CONDITIONS APPLY (I) UNLESS THE CUSTOMER HAS SIGNED A SEPARATE PURCHASE AGREEMENT WITH IDC DIVING CENTRE LTD., IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN; OR (II) UNLESS OTHER IDC DIVING CENTRE LTD. STANDARD TERMS APPLY TO THE TRANSACTION.

1. Order Shipping, Delivery Methods & U.S. Duties

A. Domestic Canadian Shipments

IDC Diving Centre Ltd. ships orders across Canada using a network of reliable courier partners. Depending on your destination, we select the optimal expedited service to ensure your dive gear arrives as quickly as possible.

• Free Shipping Orders ($200+ Subtotal Before Taxes): Standard orders with a product subtotal exceeding $200.00 CAD before taxes qualify for free ground/expedited shipping across Canada (excluding oversized items).
• Flat Rate Shipping ($24.00): For orders with a subtotal under $200.00 CAD before taxes, a flat delivery fee of $24.00 CAD applies to any address nationwide.
• Oversized Items & Freight*: Select bulky or heavy items—including but not limited to large roller equipment bags, dive luggage, and heavy hardware—are subject to dedicated flat shipping charges regardless of subtotal.

B. United States Shipments & Duty Processing

Orders shipped to the United States carry a flat-rate shipping fee of $48.00 CAD.

• U.S. Customs Duties & Entry Rules: Due to U.S. Customs and Border Protection (CBP) regulations suspending duty-free de minimis exemptions for commercial goods entering the United States, all low-value and retail shipments are subject to applicable import duties and tariffs imposed by the U.S. government.
• Duty Assessment & PayLink Process: When you place an online order for U.S. delivery, our team will review the order, determine the exact U.S. duties owed according to product classification, and contact you directly. We will send an electronic PayLink to collect the duty payment prior to package dispatch.
• 5% GST Reallocation / Refund: Online orders are automatically assessed 5% Canadian GST at checkout. Because export goods leaving Canada are GST-exempt, your paid 5% GST will be credited directly toward your required U.S. duties. If the 5% GST amount exceeds your total U.S. duty bill, the remaining balance will be refunded directly back to your original payment method. If duties exceed the GST amount, the PayLink will cover only the remaining difference.
• Other International Destinations: Overseas orders outside Canada and the U.S. will be charged actual carrier shipping rates. Customers desiring an exact shipping quote prior to order dispatch should email us or leave instructions in the order notes section.

2. Return Policies (Online Purchases Only)

Any equipment or apparel purchased online from IDC Diving Centre Ltd. may be returned for a product refund subject to the following conditions:

1. 30-Day Return Window: Items may be returned for a product refund within 30 days of purchase/receipt, excluding original shipping charges.
2. "As New" Condition Required: Returned items must be strictly clean, unused, and delivered in original "as new" condition with all original packaging, tags, manuals, and literature attached.
3. Postage & Free Shipping Deductions: Return postage is the sole responsibility of the Customer. Outgoing shipping charges are non-refundable. If your purchase qualified for our Free Shipping promotion, the actual cost of original outgoing shipping will be deducted from your final refund.
4. Return Authorization: Please contact us at info@diveidc.com prior to shipping items back to receive authorization and instructions.
5. Christmas / Holiday Shoppers: To assist holiday shoppers, items purchased online between November 20th and December 24th may be returned or exchanged in "as new" condition with all original packaging until January 5th, or 30 days after purchase/receipt (whichever period is longer).
6. Dive Computers: Used dive computers or units registered with the manufacturer cannot be returned. We will gladly assist with warranty claims through the manufacturer during the official warranty period. Items returned found not to be in original condition will be shipped back at the client's expense without refund.
7. Special Orders & Non-Returnable Items: Special orders are not subject to standard return policies and require prior consultation before return shipment. Camera Housings and Drysuits are strictly non-returnable. Please call or email us for technical clarification prior to purchase.

3. Product Exchanges & Sizing

IDC Diving Centre Ltd. may, at its sole discretion, exchange products within 30 days of receipt. All returned items for exchange must accompany original packaging, tags, and literature in "as new" condition. IDC provides free regular or expedited shipping on a one-time size exchange within Canada. Subsequent exchanges are subject to standard shipping fees. Holiday purchases (Nov 20th – Dec 24th) may be exchanged until January 5th or 30 days after receipt. Items shipped back without prior communication will not be accepted.

4. Course & Charter Trip Cancellation Policies

• PADI Course Medicals: A completed PADI medical form is required for every diving course. Confirming health requirements online, by phone, or in person and then answering "YES" to medical questions at course start without documented physician clearance will prevent pool attendance without refund eligibility.
• Course Cancellations & Transfers: Course cancellations incur a $125.00 cancellation fee plus material/shipping costs. Course transfers require a minimum of 96 hours' notice; transfers with less than 96 hours' notice incur a $100.00 transfer fee.
• Boat Dives & Trips: Booking trips and boat dives requires full payment to confirm space. Trip cancellations require a minimum of 5 business days' notice prior to departure. Cancellations within 5 business days are non-refundable unless your spot can be resold.

5. Shortages & Shipping Damage

Customer must check all package contents for accuracy within 48 hours of receipt. No items shall be invoiced unless shipped. Shortages must be reported to IDC Diving Centre Ltd. within 48 hours to file a claim. In the case of shipping damage, the Customer must file a claim directly with the delivery carrier.

6. Other Documents & Amendments

Other than as specifically provided in any separate formal purchase agreement between Customer and IDC Diving Centre Ltd., these terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement, or amend this document or to enter an order for product(s) subject to additional or altered terms will be null and void unless agreed upon in a written agreement signed by both Customer and IDC Diving Centre Ltd.

7. Governing Law

THIS AGREEMENT AND ANY SALES THEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE PROVINCE OF BRITISH COLUMBIA, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.

8. Payment Terms, Quotes & Taxes

Terms of payment are within IDC Diving Centre Ltd.'s sole discretion, and payment must be received prior to acceptance of an order. Payment for products and services may be made by credit card, wire transfer, or prearranged payment method. IDC Diving Centre Ltd. may invoice parts of an order separately. Quotations given will be valid for the period stated on the quotation and are subject to stock availability. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law.

Unless Customer provides a valid and correct tax exemption certificate applicable to the ship-to location prior to order acceptance, the Customer is responsible for sales and all other taxes associated with the order (except IDC Diving Centre Ltd. income tax).

9. Title & Risk of Loss

Title to products passes from IDC Diving Centre Ltd. to Customer upon shipment from our facility. Loss or damage occurring during shipping by a carrier selected by IDC Diving Centre Ltd. is our responsibility. Loss or damage occurring during shipping by a carrier selected by the Customer is the Customer's responsibility. Once tracking indicates items have been delivered, IDC Diving Centre Ltd. holds no responsibility for loss or theft. We strongly recommend that high-value shipments require a signature upon delivery.

10. Warranties & Retailer Role

LIMITED WARRANTIES APPLICABLE TO SCUBA EQUIPMENT ARE INCLUDED DIRECTLY FROM THE EQUIPMENT MANUFACTURER IN DOCUMENTATION PROVIDED WITH PRODUCTS. THERE ARE NO WARRANTIES FOR SERVICES. IDC DIVING CENTRE LTD. MAKES NO EXPRESS WARRANTIES EXCEPT THOSE STATED IN IDC DIVING CENTRE LTD.'S APPLICABLE WARRANTY STATEMENT IN EFFECT ON THE INVOICE DATE. WARRANTY OBLIGATIONS ARE EFFECTIVE ONLY UPON RECEIPT OF FULL PAYMENT FOR THE WARRANTED ITEM.

IDC Diving Centre Ltd. acts as a retailer. Warranties and technical support on third-party products purchased through IDC Diving Centre Ltd. are provided by the original manufacturer and not by IDC Diving Centre Ltd.

11. Products & Substitutions

IDC Diving Centre Ltd. continually upgrades and revises its products and service offerings. In the event that an ordered product is out of stock, Customer will be contacted prior to any product substitutions.

12. Limitation of Liability

IDC DIVING CENTRE LTD. DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR THE PROVISION OF SERVICES AND SUPPORT. IDC DIVING CENTRE LTD. WILL NOT BE LIABLE FOR CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. CUSTOMER AGREES THAT LIABILITY IS NOT TO EXCEED THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER.

SCUBA DIVING EQUIPMENT SHOULD ONLY BE USED BY CERTIFIED SCUBA DIVERS. IDC DIVING CENTRE LTD. DOES NOT ACCEPT LIABILITY FOR THE USE OF SCUBA EQUIPMENT BY NON-CERTIFIED INDIVIDUALS.

13. Binding Arbitration

ANY CLAIM, DISPUTE, OR CONTROVERSY (IN CONTRACT, TORT, OR OTHERWISE) AGAINST IDC Diving Centre Ltd., its agents, employees, successors, or affiliates arising from or relating to this Agreement, advertising, or purchases SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION IN BRITISH COLUMBIA. The arbitration will be limited solely to the dispute between Customer and IDC Diving Centre Ltd.

14. Technical Service & Support

IDC Diving Centre Ltd. will provide general technical support to Customer in Canada & the United States in accordance with current technical support policies in effect. IDC Diving Centre Ltd. has no obligation to provide service or support until full payment has been received for the product or service contract.
